OSHA has a sister agency, the Mine Safety & Health Administration (MSHA), that has superpowers when it comes to safety and health enforcement. MSHA also considers construction contractors to be "mine operators," their workers to be "miners" requiring specialized training, and the unwary may fall into traps such as the new mandate for documentation of workplace examinations each shift by contractors and host employers alike. This session will cover the nuts and bolts of interfacing with MSHA: from strict liability and warrantless search authority to mandated training and documentation, civil and criminal liability. Being proactive can avoid extreme company and personal penalties that can be imposed under the Mine Act for violations of standards and whistleblower rights!
